A legal disclaimer

The information provided below outlines SOS Children's Villages Jamaica's approach to donor contributions and refund requests. This policy establishes the framework between SOS Children's Villages Jamaica and our supporters regarding donations and circumstances under which refunds may be issued.

Our policy: the basics

This Donation and Refund Policy serves as a legally binding agreement between SOS Children's Villages Jamaica and donors regarding the processing, handling, and potential refund of contributions. As a registered charity operating under Jamaica's Charities Act (2013) and Charities Regulations (2022), we maintain transparent practices for all donations received. This policy helps ensure compliance with regulatory requirements while protecting both our organization and our donors.

What this policy covers

Our policy addresses several key areas: the timeframe for requesting refunds; conditions under which full or partial refunds may be granted; documentation requirements for refund requests; donor verification procedures; and the handling of both monetary and in-kind contributions.

Monetary donations

One-time Donations: All one-time donations are considered final upon processing. However, we will consider refund requests under the following circumstances:

  • Technical errors resulting in duplicate charges

  • Unauthorized transactions made without the donor's knowledge or consent

  • Donations exceeding the intended amount due to processing errors

 

Refund requests must be submitted within 30 days of the transaction date. Requests submitted after this period will be evaluated on a case-by-case basis.

Monthly Recurring Donations: Donors may cancel recurring donations at any time through their donor portal or by contacting our Fund Development team. Cancellations take effect at the end of the current billing cycle. Refunds for previous months will only be considered if technical errors can be documented.

High-Value donations

For donations totaling or exceeding JMD $500,000, additional donor verification procedures apply in accordance with Regulation 10(4) of the Charities Regulations (2022). These procedures may include:

  • Identity verification through government-issued documentation

  • Source of funds verification for cash donations

  • Enhanced due diligence for donations from international sources or politically exposed persons

Donors will be contacted to complete the registration process once their cumulative contributions reach this threshold. These measures protect both donors and our organization while ensuring regulatory compliance.

In-Kind donations

Non-monetary contributions including goods, services, or property are valued at the time of receipt according to our established valuation procedures. Once accepted, in-kind donations become the property of SOS Children's Villages Jamaica and cannot be returned or refunded. Donors will receive documentation of the appraised value for tax purposes where applicable.

Requesting a refund

To request a refund, donors must:

  1. Submit a written request to information@sos-jamaica.org within 30 days of the transaction

  2. Include the transaction date, amount, payment method, and proof of transaction (if available)

  3. Provide a detailed explanation of the reason for the refund request

  4. Include any supporting documentation for claims of technical error or unauthorized use

All refund requests are reviewed by our Finance and Compliance teams. Approved refunds will be processed within 14 business days and returned using the original payment method.

Donor privacy and data protection

All donor information is maintained according to Jamaica's Data Protection Act (2020) and our internal privacy standards. Records of donations, including verification documentation for high-value contributions, are retained for seven years as required by Regulation 16 of the Charities Regulations (2022).

Tax receipts

Official tax receipts are issued for all eligible donations. If a donation is refunded, donors are responsible for adjusting their tax filings accordingly. Revised receipts will be provided upon request.
